Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ScammerCheck.ai (the “Service”).

The Service is operated by 16500412 Canada Inc., a corporation incorporated under the Canada Business Corporations Act, operating as Brilithic Technologies, with its registered office in Calgary, Alberta, Canada (“Company”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

1. Description of Service

ScammerCheck.ai provides an automated browser-based tool that analyzes submitted emails, URLs, screenshots, or text to generate a risk assessment indicating whether submitted content may exhibit characteristics commonly associated with scams or fraudulent activity.

The Service:

  • Is provided for informational purposes only.
  • Does not provide legal, financial, investigative, or professional advice.
  • Does not make factual determinations of fraud, illegality, or wrongdoing.
  • Does not guarantee accuracy, completeness, or reliability.

All outputs are automated and probabilistic in nature.

2. No Determination of Wrongdoing

The Service provides automated pattern-based risk assessments.

Results:

  • Do not constitute accusations.
  • Do not constitute factual findings.
  • Do not assert that any individual or entity has committed fraud or unlawful conduct.
  • Should not be interpreted as defamatory statements or verified claims.

Users are solely responsible for how they interpret and use the results.

3. Eligibility

You must be at least 13 years old to use the Service.

If you are under the age of majority in your jurisdiction, you confirm that you have parental or guardian consent.

4. User Responsibilities

You agree:

  • Not to use the Service for unlawful purposes.
  • Not to upload content you do not have the legal right to submit.
  • Not to use the Service to harass, defame, or harm any person or entity.
  • Not to attempt to reverse engineer, exploit, or interfere with the Service.

You are solely responsible for any content you submit.

5. User Content License

By submitting content, you represent and warrant that:

  • You have the legal right to submit the content.
  • The content does not infringe intellectual property rights.
  • The content does not violate privacy rights.

You grant the Company a non-exclusive, worldwide, royalty-free license to use submitted content solely for:

  • Operating the Service
  • Improving detection models
  • Security and fraud prevention
  • Internal research and analytics

We do not claim ownership of your content.

6. AI & Automated Processing Disclosure

The Service may use machine learning models, automated classifiers, and artificial intelligence systems.

Outputs:

  • May contain errors.
  • May generate false positives or false negatives.
  • Are not human-reviewed unless explicitly stated.

You acknowledge and accept the inherent limitations of automated systems.

7. No Warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy
  • Reliability
  • Availability

We do not guarantee uninterrupted or error-free operation.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Company shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages.
  • We are not liable for loss of profits, data, reputation, business opportunity, or goodwill.
  • We are not liable for decisions made in reliance on the Service.

The Company's total aggregate liability shall not exceed CAD $100.

If your jurisdiction does not allow certain exclusions, liability shall be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless 16500412 Canada Inc., its directors, officers, contractors, and affiliates from any claims, liabilities, damages, losses, or expenses arising from:

  • Your misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

  • Are not responsible for data practices of advertisers.

Your interaction with third-party services is at your own risk.

14. Governing Law & Jurisdiction

You agree that any dispute shall be brought exclusively in the courts located in Alberta, Canada.

You waive any objection to jurisdiction or venue in such courts.

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

Continued use of the Service after changes constitutes acceptance of the updated Terms.
